These Point-of-Sale Terms are the disclosures we make to you at the moment of sale, gathered in one place so you can read them before you buy and keep them after you have. They restate, without changing, the terms of the Subscription Terms that govern what you pay, when you are charged, and how you stop being charged.
Amounts on this page are examples of the form a disclosure takes. The amounts that apply to you are the ones shown in your order summary at checkout and afterwards in Billing & plan in your account.
1. Before you choose a plan
Under the recurring total, in the same size and color as the price, we tell you how the subscription renews:
Renews automatically. Your subscription renews every month at the recurring amount shown plus any applicable tax, for the number of locations shown, until you cancel. Cancel any time from Billing & plan in your account. Cancellation takes effect at the end of the billing period you have paid for. There is no free trial. The first billing period is charged today.
Quarterly and yearly plans carry the same sentence with their own period: "renews every three months" or "renews every year".
Under the yearly option only:
Price lock. Yearly subscribers keep their signup price for the plan and modules active at signup, as long as the subscription stays active and payments are up to date.
Under the one-time White-Glove Setup option:
One-time fee of $1,000.00, charged today. Not part of the recurring fee.
Below the prices:
Prices are in US dollars and do not include sales tax. Where we must collect tax it is shown before you pay.
2. On the signup page, immediately before payment
A summary row states, in four cells, the plan and its modules with the number of locations; the amount due today, before any promotion code you enter on the payment form; what the subscription renews at and when it first renews; and that you can cancel any time, online, from Billing & plan in your account.
Beneath the summary, in full-size body text and not as a footnote, the automatic-renewal disclosure:
Automatic renewal. By subscribing you agree that your subscription renews automatically every year. We will charge the recurring amount shown plus any applicable tax to your payment method on the renewal date shown, and every year after that, until you cancel. You can cancel at any time from Billing & plan in your account, or by emailing legal@thatmenuapp.com. Cancellation takes effect at the end of the billing period you have already paid for. We do not refund the unused part of a billing period.
Monthly and quarterly plans carry the same sentence with their own period. Yearly plans add: your price is locked as long as your subscription stays active and your payments are up to date.
Immediately beneath that paragraph, with no form field between them, sit the consent controls. Both are unchecked when the page loads and the submit button stays disabled until both are checked:
I agree to the Subscription Terms and to automatic renewal as described above.
I agree to the Terms of Use and have read the Privacy Policy.
Under the submit button:
Payment is taken by our payment processor on the next screen. Your card details never pass through That Menu App.
3. What we record when you agree
When you submit the form we store with your account that you checked the Subscription Terms control, the date and time in UTC, and the version of each document you were shown — the Subscription Terms, the Terms of Use and the Privacy Policy. If you subscribed before this record existed, we store the same fact when your subscription is created.
4. At the payment step
The payment form belongs to our payment processor; your card details never pass through That Menu App. Its line items match the summary you were shown. Above the form, one line restates what you are buying:
You are subscribing to the plan shown at the recurring amount shown every year, renewing automatically until you cancel.
5. After you pay
On the confirmation page:
Your subscription is active. The plan, the recurring amount and its period, renewing automatically, the first renewal date, and that you can cancel any time from Billing & plan.
We send an acknowledgement email to the contact address on the account, within minutes of the first successful payment, with a plain-text version always included. It restates what you subscribed to and for how many locations; what you paid today; the automatic-renewal terms in full; how to cancel; where to find your invoices; and the version of the Subscription Terms that applies to you.
6. How to cancel
Sign in as the account owner, open Billing & plan and choose Cancel subscription. This opens our secure billing portal, where you confirm. Or write to legal@thatmenuapp.com with your restaurant name and the word "cancel"; we will schedule the cancellation and confirm within two business days.
Cancellation takes effect at the end of the billing period you have paid for, and no further charges are made. We do not refund the unused part of a billing period. For 30 days after your subscription ends you can ask us for a copy of your menu and allergen records, or restart with your data intact, by writing to legal@thatmenuapp.com.
7. Invoices and billing history
Your invoices and billing history are available from Billing & plan, which opens our payment processor's billing portal.
8. Tax
Every recurring-charge disclosure says "plus any applicable tax". We do not collect sales tax today. The Subscription Terms permit us to add it, and where we must collect it, it is shown to you before you pay. A disclosed amount is never smaller than the amount charged.
9. Changing your plan or adding a location
To add a location, or to change your plan, write to us at legal@thatmenuapp.com and we will quote the change and make it for you. You cannot make either change yourself yet.
